El Cerrito Deck and Fence provides residential and commercial deck building, fence installation, and related outdoor structure services in El Cerrito, California and surrounding communities. Services include but are not limited to custom deck design and build, composite deck installation, wood fence installation, pergola installation, deck repair, and patio covers.
All services are subject to scope of work agreements confirmed in writing before work begins. We reserve the right to decline any project at our discretion.
Written estimates are provided at no charge following an in-person site visit. Estimates reflect conditions observed at the time of the visit and are valid for 30 days from the date issued.
An estimate is not a binding contract. A project begins only after both parties sign a written agreement that specifies the scope of work, materials, timeline, and total price.
Unforeseen site conditions discovered during construction - such as rotted framing, hidden structural damage, or conditions that differ materially from what was visible at the time of the estimate - may require a change order. We will notify you in writing before proceeding with any work that increases the contract price.
Start dates are confirmed in writing when you sign a project agreement. Scheduling is subject to permit approval timelines and material availability, both of which are outside our control. We will communicate any changes to your start date as promptly as possible.
If you need to reschedule or cancel a project after signing an agreement, please notify us in writing at projects@elcerritodeckandfence.com as soon as possible. Cancellations made after materials have been ordered or work has begun may be subject to costs incurred up to that point.
We reserve the right to reschedule projects due to weather conditions that would compromise the quality or safety of the work.
Payment terms are specified in each project agreement. Typically, a deposit is due at contract signing, and the remaining balance is due upon project completion. Specific payment schedules for larger projects may be outlined in the project agreement.
Accepted payment methods will be specified in your project agreement. Invoices not paid within the timeframe specified in the agreement may be subject to a late payment fee as stated in that agreement.
We reserve the right to suspend work on a project if payments are not received according to the agreed schedule.
Where required by local ordinance, El Cerrito Deck and Fence obtains building permits on behalf of the property owner. Permit fees are included in the project estimate unless otherwise specified.
The property owner is responsible for ensuring that the planned construction complies with any applicable homeowners association (HOA) rules or deed restrictions. We recommend confirming HOA approval, if applicable, before signing a project agreement.
El Cerrito Deck and Fence warrants that all work will be performed in a workmanlike manner using materials specified in the project agreement. Any warranty on workmanship will be stated in your project agreement.
Material warranties are subject to the terms provided by the respective manufacturers. We will provide manufacturer warranty documentation for major materials upon project completion.
Warranties do not cover damage caused by misuse, neglect, unauthorized modifications, acts of nature (including earthquakes, flooding, or fire), or conditions that arise from pre-existing deficiencies not disclosed prior to the project start.
To the maximum extent permitted by applicable law, El Cerrito Deck and Fence shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of our website or from the provision of our services, including but not limited to loss of profits, loss of use, or damage to property not directly caused by our work.
Our total liability to you for any claim arising from our services shall not exceed the total amount paid by you for the specific project giving rise to the claim.
If a dispute arises between you and El Cerrito Deck and Fence regarding any project or these terms, we ask that you first contact us directly to attempt to resolve the matter informally. Most concerns can be resolved through a direct conversation.
If informal resolution is not possible, disputes shall be resolved through binding arbitration in Contra Costa County, California, in accordance with the rules of the American Arbitration Association. Nothing in this clause prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction.
These terms and conditions are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any legal proceedings not subject to arbitration shall be brought in the courts of Contra Costa County, California.
